Terms of Service

1. Acceptance of Terms

By accessing or using Persona AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Persona AI is operated from the Netherlands, European Union. By using the Service, you acknowledge that your use is subject to Dutch and EU law.

2. Description of Service

Persona AI is an AI companion chat application that allows users to interact with AI-powered characters. Key features include:

  • Conversational AI characters with distinct personalities and persistent memory.
  • Proactive messaging — characters may initiate conversations with you.
  • AI-generated photos created by characters during conversations.
  • Optional integrations with third-party services (Google Calendar, YouTube, Apple Music, Twitch) to personalize conversations.

The Service is provided "as is" and may be modified, updated, or discontinued at any time.

3. User Accounts

To use Persona AI, you must create an account using Google OAuth sign-in. You agree to:

  • Provide accurate account information.
  • Maintain the security of your account by protecting your Google account credentials.
  • Notify us immediately of any unauthorized access to your account.
  • Accept responsibility for all activities that occur under your account.

You must be at least 13 years old to use the Service. Users between 13 and 16 in the EU may require parental consent in accordance with local law.

4. Subscriptions & Payments

Persona AI offers both free and premium subscription tiers. Premium features are available through in-app purchases processed exclusively by the Apple App Store or Google Play Store.

  • Billing— all payments are handled by Apple or Google. We do not collect, store, or process payment card information.
  • Recurring subscriptions— subscriptions automatically renew unless cancelled before the end of the current billing period through your App Store or Google Play settings.
  • Refunds— refund requests must be directed to Apple or Google, as they process all payments. We cannot issue refunds directly.
  • Price changes— we reserve the right to change subscription pricing. Existing subscribers will be notified in advance of any price increase.
  • Free tier— free features may be modified or limited at any time without prior notice.

5. Content & Conduct

When using Persona AI, you agree not to:

  • Use the Service for any illegal, harmful, or fraudulent purpose.
  • Attempt to manipulate AI characters into generating harmful, abusive, or illegal content.
  • Harass, threaten, or impersonate other users or any real person.
  • Share content generated by the Service that could be mistaken for real photographs of real people.
  • Reverse-engineer, decompile, or attempt to extract the source code or AI models underlying the Service.
  • Use automated scripts, bots, or scrapers to access the Service.
  • Circumvent or attempt to circumvent any access controls, rate limits, or subscription restrictions.
  • Distribute, sublicense, or commercially exploit content generated by the Service without our prior written consent.

We reserve the right to suspend or terminate accounts that violate these rules, at our sole discretion and without prior notice.

6. AI-Generated Content

Persona AI uses artificial intelligence to generate text responses and images. You acknowledge and agree that:

  • Characters are fictional. AI characters are not real people. Their responses are generated by machine learning models and do not reflect the views, opinions, or advice of any real person or of Persona AI.
  • Not professional advice. AI-generated responses should not be relied upon as medical, legal, financial, psychological, or any other form of professional advice. If you need professional help, consult a qualified professional.
  • No guarantee of accuracy. AI responses may contain inaccuracies, fabrications, or outdated information.
  • AI-generated images are synthetic. Photos generated by AI characters are entirely artificial and do not depict real people, places, or events.
  • Content moderation. While we implement safety measures and content filters, no AI system is perfect. If you encounter inappropriate content, please report it to us.
  • Character memory limitations. AI characters maintain memory of past conversations, but this memory may be imperfect, incomplete, or occasionally inconsistent.

7. Intellectual Property

  • Our IP— the Persona AI app, its characters, character designs, branding, UI, and underlying technology are owned by us or our licensors. You may not copy, reproduce, or create derivative works from our intellectual property without our written permission.
  • Your content— you retain ownership of the messages you send through the Service. By sending messages, you grant us a limited, non-exclusive license to process and store your content solely for the purpose of providing and improving the Service.
  • AI-generated content— images and text generated by AI characters are provided for your personal, non-commercial use. You may share AI-generated content on social media with attribution to Persona AI, but may not commercially exploit it.

8. Third-Party Services & Integrations

Persona AI may integrate with third-party services (Google Calendar, YouTube, Apple Music, Twitch). These integrations are optional and subject to the respective third party's terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

You may connect or disconnect integrations at any time through the app settings.

9. Termination

By you: You may delete your account at any time through the app settings or by contacting us at rebel.gg.team@gmail.com. Upon deletion, your data will be removed within 30 days in accordance with our Privacy Policy.

By us: We may suspend or terminate your account at any time if you violate these Terms, if required by law, or if we discontinue the Service. Where possible, we will provide reasonable notice before termination.

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will remain in effect.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • AI-generated responses will be accurate, complete, or appropriate.
  • The Service will meet your specific requirements or expectations.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PERSONA AI, ITS OPERATORS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY EUROS (EUR 50), WHICHEVER IS GREATER.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or gross negligence.

12. Indemnification

You agree to indemnify and hold harmless Persona AI, its operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

If you are a consumer in the EU, you retain any mandatory protections provided by the laws of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.

The European Commission provides an online dispute resolution platform for consumers.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the app or by email at least 30 days before the changes take effect.

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Service and delete your account.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
